Clearway Payments — Privacy Policy

1. Overview
This Privacy Policy explains how Clearway Payments ("Clearway," "we") collects, uses, and protects information when you apply for and use card‑payment services through us. Card processing is provided by Paysafe Payment Processing Solutions, LLC and Citizens Bank, N.A. (the "Servicers"), who process your information under their own agreements and privacy practices.
2. Information we collect
To underwrite and set up a merchant account, we collect information you provide in the application, including:
- Business information: legal name, DBA, tax ID (EIN), addresses, contact details, website, business type, processing volumes, and sales methods.
- Ownership & principal information: names, titles, ownership percentages, Social Security numbers, dates of birth, home addresses, driver's license numbers, and contact details for owners (25%+) and a controller.
- Financial information: bank name, routing number, and account number for settlement.
- Signature & consent records: your electronic signature, the time you signed, your IP address, and browser information (for the ESIGN audit trail).
3. How we use it
We use your information to: evaluate and submit your application to the Servicers; verify your identity and business; obtain a credit report where you have authorized it (FCRA consent); set up and service your account; comply with legal, tax, and Card Brand requirements; and communicate with you about your application and account.
4. How we protect it
- Encryption in transit and at rest. Sensitive fields (SSN, date of birth, driver's license, and bank account details) are encrypted before storage using industry‑standard AES‑256 encryption. Data in transit is protected with TLS.
- Access controls. Only authorized personnel and the Servicers can access application data, and only as needed to underwrite and service your account.
- Retention. We retain application records as long as needed to provide services and to meet legal and Card Brand recordkeeping obligations (generally at least seven years for transaction‑related records).
5. How we share it
We share your information with: the Servicers (Paysafe and Citizens Bank) and their agents and subcontractors to underwrite and service your account; credit reporting agencies (e.g., Experian) where you authorized a credit inquiry; and service providers that host or process data on our behalf under confidentiality obligations. We do not sell your personal information. We may disclose information where required by law or to prevent fraud.
6. Your choices
You may request access to or correction of your information, withdraw certain consents (for example, automated marketing calls or messages) as described in your application, and ask questions about how your data is handled by contacting us. Some information must be retained to meet legal and processing obligations.
7. Automated communications
By providing your phone number, you consent to receive calls and messages (including via automated systems) about your application and account, as described in your application. You may withdraw marketing consent at any time.
